Please read these Terms of Service ("Terms") carefully before using the "Upload Center" Shopify application ("Application") provided by Quaflow ("we", "us", or "our"). By installing and using this Application in your Shopify store, you agree to be legally bound by these Terms. If you do not agree to these Terms, you should not install or use the Application.
1. Service Description
Upload Center is a Shopify application that allows Shopify store owners ("Store Owner", "you") to enable their customers ("Store Customer") to upload files (images, documents, etc.) during the order creation process. Uploaded files are stored directly on Google Cloud Storage.
2. Fair Use Quota and Storage
a. The Application offers each Store Owner a monthly fair use quota of 100 GB (One Hundred Gigabytes) on Google Cloud Storage. This quota covers the total size of uploaded files.
b. This quota renews at the beginning of each calendar month. Unused quota does not roll over to the next month. This quota is designed to meet the needs of the vast majority of our users.
c. Store Owners requiring a storage quota higher than 100 GB per month should contact our corporate sales team at [email protected] for custom plans and pricing.
d. Important Note: Files uploaded by Store Customers are not hosted on Upload Center or Quaflow servers. Files are stored directly in the Google Cloud Storage account linked by the Store Owner through the Application.
3. Content Responsibility and Legality
a. The Store Owner and Store Customers are solely responsible for the content, accuracy, and legality of all files uploaded through the Application.
b. It is the Store Owner's responsibility to ensure that uploaded files comply with copyright, privacy laws, trademarks, or other third-party rights, and all applicable laws and regulations.
c. Quaflow does not monitor, endorse, or control the content of uploaded files. Uploading illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable content is strictly prohibited.
d. Quaflow reserves the right to share relevant files with competent legal authorities or remove access to files upon legal request (court order, official demand, etc.) if legally required.
4. Data Retention
a. By default, files uploaded by Store Customers are stored on Google Cloud Storage for a period of 30 (Thirty) days, after which they may be automatically deleted.
b. For situations requiring file storage longer than 30 days, Store Owners should contact our corporate sales team at [email protected] to discuss custom retention solutions and terms.
5. Prohibited Activities
The following activities are strictly prohibited:
- Using bots, spiders, scrapers, or other automated means to overload the Application's servers or infrastructure.
- Engaging in any activity intended to disrupt, interrupt, or compromise the normal operation or security of the Application or its servers.
- Using the Application for any illegal purpose or in any manner not permitted by these Terms.
- Reverse engineering, decompiling, or attempting to derive the source code of the Application.
6. Security
a. Store Owners and Store Customers are obligated to immediately notify Quaflow authorities at [email protected] if they become aware of any security vulnerability or potential security risk in the Application.
b. The data integrity and security of the Google Cloud Storage platform where files are stored are the responsibility of Google LLC and are subject to the Google Cloud Platform Terms of Service. The Upload Center application is solely responsible for facilitating the secure upload process to Google Cloud Storage.
c. Quaflow and Upload Center accept no liability for data corruption, deletion, or any access issues occurring on Google Cloud Storage that originate from Google. Taking additional measures for data redundancy and protection is the responsibility of the Store Owner.
7. Intellectual Property
The Upload Center Application and all related software, code, designs, graphics, and content are the intellectual property of Quaflow and are protected by copyright laws and international treaties. You are granted only a limited, non-exclusive, non-transferable license to use the Application in accordance with these Terms.
8. Limitation of Liability
To the maximum extent permitted by law, Quaflow shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including, but not limited to, loss of profits, loss of data, or business interruption) arising out of the use or inability to use the Application. This applies even if Quaflow has been advised of the possibility of such damages. Specifically, Quaflow is not responsible for data loss or service interruptions originating from Google Cloud Storage.
9. Changes to Terms
Quaflow reserves the right to modify these Terms at any time. Changes become effective immediately upon being posted within the Application interface or notified to you via email. Your continued use of the Application after changes constitutes your acceptance of the updated Terms.
10. Termination
Quaflow reserves the right to suspend or terminate your access to the Application without prior notice if you violate any provision of these Terms.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia. Unless otherwise agreed in writing by the parties, any dispute, claim, or controversy arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the Harju County Court (Harju Maakohus) in Estonia.
